Does the Montana lemon law cover used vehicles?+

Mont. Code Ann. § 61-4-501 (Montana Lemon Law) primarily covers new vehicles. The federal Magnuson-Moss Warranty Act (MMWA) frequently extends to used vehicles that came with any written warranty — manufacturer remaining warranty, certified pre-owned warranty, or a dealer's used-car warranty. We evaluate whether your case fits state law, federal MMWA, or both.

How many repair attempts does Montana require?+

Montana's statutory presumption: 4 repair attempts OR 30 days out of service in first 2 years / 18,000 miles. Federal MMWA does not set a fixed number — it requires a 'reasonable opportunity' for the manufacturer to repair, which is fact-specific.

Do I have to arbitrate before suing in Montana?+
